+/– UCR fees not finalized; enforcement delay encouraged. With the end of the year rapidly approaching, truckers wanting to clear out their fee obligations are left without a clear answer on what they owe in Unified Carrier Registration fees.
The Federal Motor Carrier Safety Administration posted a notice to the Federal Register in September outlining new proposed fees. The extended comment period closed in late September.
FMCSA officials reported during the rulemaking process that states have been unable to effectively collect the UCR revenue they are entitled to by law during the 2007-2009 registration years. They believe the proposed new fee levels will both encourage states to aggressively enforce the UCR fees rule and generate the necessary revenue to execute state motor carrier safety programs.
The fee structure proposed in the rulemaking for 2010 is:
trucks – $83
2-5 trucks – $166
6-20 trucks – $497
21-100 trucks – $1,741
101-1,000 trucks – $8,373
1,001 or more trucks – $82,983

I don't understand wording of enforcement delay encouraged. Does this mean they could right you a citation for not having a 2010 UCR? Anyone wanna bet as soon as they make a final ruling the Dot will be enforcing it the next day and will give you no time to get this done.
Thinking that is the idea. Still have no clue how they can say "encouraged" when there is nowhere to pay the fee upfront & they haven't even decided what the fee will be.
Just a note, when the fees are finalized and put into place. You can pay your fee online and obtain your receipt within minutes, which is sufficient for inspections. But until then, we may see citations of an un-enforceable law. The officers will probably write tickets anyway causing grief, but any judge will have to dismiss the case.
However, under the new CSA 2010... I wonder if they'll make this a driver point? Hmmm... seems like shady timing.
I am going to be carrying one extra sheet of paper in the truck until this gets resolved. Just in case some goofball in a KS weigh station didn't get the memo, I'll provide one for them :D

Inspection Bulletin 2009-02, December 23, 2009 announces a moratorium on enforcement of the UCR effective January 1, 2010 for the 2010 registration year. This moratorium shall remain in effect until further notice. Please be advised that this moratorium does not impact UCR requirements as they relate to previous years.
Background
An amendment to SAFETEA-LU has changed the methodology for determining fleet size by including only power units and eliminating trailers for the 2010 UCR registration year. This significant change to the statute requires modifications to the fee structure that must first be promulgated in federal regulation in order for the program to proceed.
When the rule making is completed participating states will mail registration notices to all entities subject to the UCR allowing for a reasonable time period for companies to remit their fees.
When participating states have agreed on a 2010 enforcement date an updated enforcement bulletin will be issued.
Enforcement of a Previous UCR Registration Year (2007 - 2009) after January 1, 2010
In order for roadside enforcement of a previous UCR registration year to take place after January 1, 2010, enforcement staff should first obtain evidence of interstate operations occurring during that particular registration year. Proof may include but not be limited to log entries; toll receipts; shipping papers; bills of lading; previous years apportioned receipt or prior years roadside inspection reports.

havent checked the ucr site rather ask you guys, lol, whatz going on with this??? Im still not on the 2010 list, lol, i got my last ucr sept 2009. What a jip

Kansas & Oklahoma will have to come up with something else to grill people over.
Still wish they would come up with ONE fee to run a truck nation wide.
Want a truck to run at 30,000 lbs in all 48 states, price is X period. Not this tax due on the second Tuesday of the month for this & that tax for that & another fine because we didn't tell you about the surcharge that was due three weeks before you started.

Well, UCR is up and running as of today. The price doubled!!! Looks like they had screwups already on the update so there system doesnt work right now untill 11am. Go spend that money, u know they are gonna be enforcing this like crazy considering............... the delays and the secretivity. Well, i know some people got stuff in mail, but I didnt. Pay up people!!!!!

wow, its 4pm now. And still not running. I will post up when its actually done!!! We could be doing updates 2 hours at a time and may not be ready till next year. Guess they are really anal about getting that butt load of initial money in and would rather say 2 hour updates instead of come back tomorrow. Guess our government is really in debt to have a few billion tonight instead of tomorrow. lol. Theyre prolly all pissed off at there IT who does there site because he cant get a simple 2010 addon like the previous years, Costing the goverment billions they coulda already had. SOmebody is getting fired!!!!!!!

Ive been following the ucr page everyday now, multiple times a day. I gave up, they dont know what there doing over there. Everday says it will be ready the next day. Well, at least they got past the 2 hour mark

I'm not sending them 1 single god damb dime untill they send me notification at my office that they are back up and how much the fees are!! It's not my responcability to stumble along behind them while they play with themselves.

Chris, the price doubled... sort of.
Last year 0-2 units was $39, but you had to include your trailers... I paid $39 each year for '08 and '09 for 1 truck 1 trailer. Since I added a truck and trailer AFTER I had already paid my UCR, I was fine to do this. In their infinite wisdom, they have no mechanism to increase or decrease the number of pieces of equipment once you file/register.
After I paid for '09, my MCS-150 was updated to show 2 trucks and 2 trailers (the third trailer is not yet on the road) and I was expecting to pay a lot more (based on '09 fees 3-5 units would have been $227!)
Since we no longer have to pay for trailers... This years fees (if/when we actaully get to file!!!) will be $76... So yes, it is double what I paid, but I also have double the number of pieces of equipment I had when I last filed...
Since they now count ONLY power units, its actually going to be a lot cheaper for me than under the old schedule of fees ($76 this year vs. $227 based on last years fees.)
Any way you look at it its just a royal PITA... They could have simply tacked $38/ unit onto my IRP and made it easy!!
