View Full Version : Carriers are brokering/forwarding freight?

Hi folks, I'm new to this site. Thought I'd see what ya'll think about this... Many vehicles are posted on CD by carriers. Technically are they not acting as a broker or freight forwarder but without authority? Isn't this illeagal? I've taken a few of these COD, am I breaking the law too? Thanks

Theres so much law breaking in the transportation business, its crazy.. Some people are really bad with the postings and then there are some people who have overflow, but not enough to justify to become a broker. I post a few things here and there, but nobody complains about my prices, I get them moved the same day, and everybody is happy. No way in hell im telling a customer to search some more to find a broker like GAS or Countrwide or even some broker rip them off and take there deposit, i can continue with horror stories????.
I just think its bad when you got these carriers bidding on uship and posting on cd, or even worse a carrier with bought leads. I see it everyday!!! Its freaking horrible. Never heard of 1 story where DOT jumps in because there a carrier brokering. Ive taken $3500 dollar loads that were quickpay from other carriers. Its scary, but I guess its really up to the real delivering carrier if they want to take that chance or not.

If a carrier does not have broker authority and list cars, as long as the freight is:
a) ALL COD or COP
b) We are not required to send the carrier any fee
We would take a load like that.
I won't bill a carrier (no bond) who is not a broker for any freight. If we have to do that, we just pass.

Remember if a carrier post a car and in return your supposed to send them the carrier money, if you dont, you can get a big negative rating!!!! I have recieved a negative rating before over that, fought with central enough, then we sent out the money even though the carrier straight out lied on a bunch of things.
As well as when we first started to do overload, we always had the carrier pay us, thus most of the time we never got paid, so we gave them a negative. Its amazing the people who didnt pay are no longer in business though and there ratings were great at the time.
Again, its a hard choice to grab a car off a carrier. Remember those 2 white tundras i did from dallas to south pittsburg, those were paying $1700 billing. I did get paid. I had another $3500 load that was billing, got paid.
use at your own discretion. We have moved alot of cars for our company and many others, not once have I never got paid from a carrier.
But remember, there is that possibility!!!!!!!!!!!!

Yeh I guess anybody can stiff us. But will I get fined for accepting freight from a carrier during a compliance audit for example?

Nobody is ever going to check where you booked the freight from during any sort of audits.
They are interested in your maint records, employee records, drug test program, log books, etc. They could not care any less how you booked your loads...

Ok cool. I'm enrolled in a random drug test consortium with my local compliance agency. But I didn't pre test myself. Will I be in jepordy in an audit for that? I passed my new entrant safety assessment. Thanks for the info..

No pre test, think thats a big fine. You already had your audit, did the DOT say anything about your pretest or did they miss is altogether???

Have to have pre-employment test before you haul first load or 10k fine. You passed audit without it?

Wonder how it works if you get a pre employment test and start up the drug and alchy program after you been in business for awhile. Wonder if they can still fine you??

They didn't fine me for that but that was under the old rules. Wasn't on the computer when I first started and gave it the old trial & error method (aka the expensive way).

My NMDOT guy was very cool. He just verified that I was part of a drug testing consortium during my new entrant audit. He didn't ask to see results or statistics of the consortium.

Back to the original thread. I run between New England and New York City. Most of my clientel buy cars in Copart and IAA. When they buy something somewhere I don't go I post it on Central. I post it for what I would charge and I don't charge any fee. my customers know that they only need to call me to get a car moved. Now I have 2 more trucks I'm getting ready and I can hit the ground running on the DC and Buffalo routes.
